Announcement for theFood Handler Certification RuleThe new Indiana State Department of Health (ISDH) Rule 410 IAC 7-22, Certification of Food Handler Requirements. This rule became effective on June 19, 2003; however, the actual certification requirement does not take effect until January 1, 2005. After December 31, 2004, at least one (1) food handler at a food establishment must be a certified food handler. A food handler’s certification must be recognized by the Conference for Food Protection or an equivalent nationally recognized certification examination as determined by the department. Union County Health Department requires a copy of the food handler's certification to be on file in the local health office. It shall be the responsibility of the certified food handler to provide the certificate, letter or document for verification of passing the examination. The certified food handler requirement does not apply to a food establishment when the food establishment’s food handling activities are limited solely to one (1) or more of the following:

Synopsis: Food handler exemption. Provides that the certified food handler requirements do not apply to food provided by an area agency on aging's nutrition service program or by a food pantry. Provides that certain nonprofit organizations that offer food for sale at an event held for the benefit of the organization are not required to use certified food handlers. Effective: January 1, 2005 (retroactive).

SECTION 2.
IC 16-42-5.2-3.5 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS
FOLLOWS [EFFECTIVE JANUARY 1, 2005 (RETROACTIVE)]: Sec. 3.5. (a) An
organization that is exempt from the state gross retail tax under
IC 6-2.5-5-21(b)(1)(B), IC 6-2.5-5-21(b)(1)(C), or IC 6-2.5-5-21(b)(1)(D) and
that offers food for sale to the final consumer at an event held for the benefit
of the organization is exempt from complying with the requirements of this
chapter that may be imposed upon the organization for that event if the
following conditions are met:
