Temporary Food Establishment

Retail Food Establishment Sanitation Requirements

Section 98 "Temporary Food Establishment" defined:
"Temporary Food Establishment" means a retail food establishment that operates for a period of no more than fourteen (14) consecutive days in conjunction with a single event or celebration with the approval of the organizers of the event or celebration.

Please complete the application form and return it with your fee payment to the Union County Health Department, 6 West South Street, Liberty, Indiana 47353, prior to the event,

Copy of the Certified Food Handler's certification document and a government issued picture ID must be provided with the application. Certified Food Handler Requirement:: Indiana State Department of Health Title 4I0 IAC 7-22 effective June 19, 2003, "Establishments shall have the above certified food handler at the event for each day." Application for exempt status must be made with the application and a complete menu submitted for review sixty (60) days prior to an event. Title 4I0 IAC 7-22 Section 15 (a).

Food prepared in a private home may not be used or offered for human consumption in a retail food establishment. Indiana State Department of Health Retail Food Establishment Sanitation Requirements Rule 410 IAC 7-24 effective November 13, 2004 Food sources Sec. 142 (b) and Retail food establishment defined Sec. 79 (b)(2)

For persons applying for a temporary food service permit, a fee of five dollars ($5.00) shall be paid for each day of operation, not to exceed fifteen dollars ($15.00) for one event of seven continuous days or less. Fees shall be sent to the Union County Health Department prior to the event and permits shall be issued after an inspection of your food service establishment. The inspection of your food service establishment will be made by a member of our staff to determine compliance with the Indiana State Department of Health Retail Food Establishment Sanitation Requirements Rule, Title 410 LAC 7-24,
Vendors without a fee payment receipt at the time of inspection will not receive a permit and will not be able to open and serve food for the event.

All permit fees must be received in the Union County Health Department office for payment receipts to be issued prior to the event.
Normal hours for the Health Department are Monday through Friday 8:00 a.m. to 12:00 noon and I:00 p.m. to 4:00 p.m. If you have any questions, please contact our office at (765) 458-5393. Our office location address is 6 West South Street, Liberty, IN 47353 (two blocks south of the Courthouse).
